AEM Urges Support to Protect Forestry Operations
On July 14, Senator Wyden (D-OR) and Rep. Herrera Beutler (R-WA) introduced S.1369/H.R. 2541, the Silviculture Regulatory Consistency Act. This legislation reaffirms the Environmental Protection Agency’s (EPA) 35-year policy of treating forestry operations as a “non-point” source of pollution. AEM is urging members to show their support of S.1369/H.R. 2541 by visiting the AEM Action Center.
An August 2010 decision by the U.S. Ninth Circuit Court declared forest roads a “point source,” triggering costly permitting requirements under the Clean Water Act. The decision also exposes forestry operations to additional lawsuits from extreme environmental groups.
The Silviculture Regulatory Consistency Act codifies EPA’s policy of treating forestry as a non-point source subject to state regulation through “Best Management Practices” (BMPs). This approach has resulted in the development of an array of effective, comprehensive and widely used BMPs tailored to varying forest types across the country. AEM is working closely with a coalition of forestry groups to see the non-point source policy is continued.
